AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Canada Pick Daily Canada Inc. (“Company,” “we,” “us,” or “our”), concerning your access to and use of the CanadaPickDaily.com website and any related online services where you can create an account and purchase official lottery tickets through our licensed platform (collectively, the “Site” or the “Service”).

You agree that by accessing the Site or using our Service, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE OR OUR SERVICE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

1. Age Restriction & Eligibility

The Site and Service are intended for individuals who are at least 19 years old and legally permitted to purchase lottery tickets in their province or territory of residence (or any higher minimum age that may apply). By using this Site or opening an account, you represent and warrant that:

• You are at least 19 years of age (or the applicable legal lottery age in your jurisdiction, if higher).
• You are a resident of Canada and lawfully allowed to participate in the lottery products made available through our Service.
• You will not permit any other person, especially a minor, to use your account to purchase lottery tickets.

2. Intellectual Property Rights

3. User Representations

By using the Site, you represent and warrant that:

• All registration information you submit will be true, accurate, current, and complete.
• You have the legal capacity and you agree to comply with these Terms of Use.
• You are using the Site for yourself and not on behalf of any person who is under the legal lottery age.
• You will not access the Site through automated or non-human means, whether through a bot, script or otherwise, for any purpose related to ticket purchases or data extraction.
• You will not use the Site for any illegal or unauthorized purpose, including but not limited to attempting to circumvent age, location, or other eligibility requirements.
• Your use of the Site will not violate any applicable law or regulation.

4. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. As a user of the Site, you agree not to:

• Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
• Use the Site to advertise or offer to sell goods and services unrelated to our licensed lottery ticket service.
• Engage in unauthorized framing of or linking to the Site.
• Make improper use of our support services or submit false reports of abuse, fraud, or misconduct.
• Attempt to impersonate another user or person, or use another user’s account or payment method without authorization.
• Use any information obtained from the Site in order to harass, abuse, or harm another person.
• Interfere with, disrupt, or create an undue burden on the Site or the networks or services connected to the Site.

5. Lottery Ticket Orders & Third-Party Lottery Corporations

Through the Service, you may submit orders for official lottery tickets for certain draws conducted by provincial and territorial lottery corporations or other authorized issuers (“Lottery Corporations”).

• We act as an intermediary ticket service: we accept your order and payment, and then arrange for the purchase of the corresponding official ticket(s) in accordance with applicable regulations.
• The actual lottery games, draw procedures, odds, prize structures, and prize payments are governed solely by the rules of the relevant Lottery Corporations, not by us.
• Your entitlement (if any) to a prize is determined exclusively by the applicable official lottery rules and verification procedures.

We are not responsible for any changes to game rules, draw schedules, or prize structures made by Lottery Corporations. It is your responsibility to review the official rules and information made available by those organizations.

6. Disclaimer of Warranties

THE SITE AND SERVICE ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. YOU AGREE THAT YOUR USE OF THE SITE, YOUR ACCOUNT, AND OUR LOTTERY TICKET SERVICE WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

• The Site or Service will be uninterrupted, timely, secure, or error-free.
• Any information displayed regarding lottery games, draws, or results is free of typographical or technical errors at all times (official information from the Lottery Corporations prevails).
• Any lottery ticket you purchase through our Service will result in a win or prize of any kind.

We make no warranties or representations about the accuracy or completeness of the Site’s content or the content of any websites linked to this Site. You understand that participation in lottery games involves risk and that outcomes are entirely based on chance.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability to you for any claim arising out of or relating to your use of the Site or Service (including ticket orders made through the Service) will, to the maximum extent permitted by law, be limited to the total amount of service fees, if any, paid by you to us in connection with the transaction(s) giving rise to the claim.

Without limiting the foregoing, we are not liable for:

• Any errors or omissions in official lottery draw procedures, results, or prize payments, which are solely the responsibility of the relevant Lottery Corporations.
• Any inability to place or process your ticket order due to technical issues beyond our reasonable control (e.g., outages, network problems, or system failures of third parties).
• Any financial losses you incur by choosing to participate in lottery games. Participation is a discretionary leisure activity and not a source of guaranteed income.

8. Third-Party Websites and Content

The Site may contain (or you may be sent via the Site) links to other websites ("Third-Party Websites") as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties ("Third-Party Content").

Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Websites accessed through the Site. Inclusion of, linking to, or permitting the use or installation of any Third-Party Websites or any Third-Party Content does not imply approval or endorsement thereof by us. 9. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Site or Service without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site or Service.

10. Governing Law

These Terms shall be governed by and defined in accordance with the laws of Ontario, Canada, and the federal laws of Canada applicable therein. Canada Pick Daily Canada Inc. and you irrevocably consent that the courts of Ontario shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Terms or your use of the Site or Service.
